Employment categories

Positions within the University can be divided into Professional and Classified in accordance with Massachusetts General Law Chapter 75, §14.

Determination of Professional status generally follows Fair Labor Standards Act guidelines: See Department of Labor’s regulation Executive, Administrative and Professional Exemption Presentation. Positions exempt from the law will be considered Professional while those not exempt will be considered Classified.

*Exceptions are made for positions where it cannot fit into any Classification.

Classified positions are subject to Chapter 30 of Massachusetts General Laws §45 and §49. Coverage under the Fair Labor Standards Act also means application of Massachusetts minimum wage and overtime laws.

Classification is also an essential part of bargaining unit determination and the terms, benefits, privileges and conditions of employment can vary based on collective bargaining agreements. The University also recognizes that our compensation plans must be in compliance with civil rights regulations both on the state and federal levels.
