U.S. Social Security Fairness Act: What You Should Know
On January 5, 2025, President Joe Biden signed the U.S. Social Security Fairness Act (SSFA) into law. This legislation retroactively repeals the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO) to January 1, 2024. These provisions had reduced Social Security benefits for retirees who also received public pensions from non-Social Security-covered work, including many University of Massachusetts retirees.
Key Points
- Impact on Benefits: This law addresses only federal Social Security benefits and does not affect benefits under the Massachusetts OBRA, State Employees' Retirement System (MSERS/pension defined benefit plan), or the Optional Retirement Program (ORP/defined contribution plan). There is no impact on state pensions.
- WEP and GPO Repeal: The repeal of WEP and GPO will increase Social Security benefits for many retirees, including those from the University of Massachusetts, who were previously affected by these provisions.
Next Steps for Retirees
The Social Security Administration (SSA) is working on implementing the SSFA. Retirees should monitor the SSA website for updates as the changes are rolled out.
