Graduate student Shay Olmstead's research focused on a chapter of their dissertation that examines how claims brought by trans workers between 1969 and 1993 impacted the legal definitions of "sex" and "disability." They argue that judges and agencies responded to trans employment discrimination claims by refining the legal definition of "sex" as binary, "biological," and immutable. When trans workers began to find more success by framing their claims as disability discrimination, legislators explicitly wrote transsexuality out of the Americans with Disabilities Act, effectively preventing trans workers from benefitting from all employment protection legislation until the early 2000s. Shay thoroughly enjoyed how interdisciplinary the fellowship was and the ability to broaden their understanding of the relationship between law and society by working with the Legal Studies program.
