Cap Gap

The H-1B "cap-gap" occurs when an F-1 student's status and OPT work authorization expires after April 1, and before the student can start approved H-1B employment during the next fiscal year that begins on October 1. *  

Work authorization on Cap Gap is valid until April 1 of the following year unless the H-1B petition is denied, withdrawn, or revoked. For example, your OPT or STEM OPT expires on June 1, 2025, you are selected for the 2025 H-1B Lottery, cap gap is applied once your H-1B is pending, your OPT or STEM OPT work authorization extends to April 1, 2026 and you can start your H-1B anytime between October 1 and April 1, depending on your approval process.

The Cap Gap Extension of OPTthrough April 1 of the next year is granted if an H-1B petition has been filed by a Cap-Subject employer before the current period of OPT expires. The first day to file for H-1B is April 1st.

 Obtaining a cap-gap I-20 is not required to be granted the work extension but if you would like one, submit the I-20 Reprint E-Form so we can verify your cap gap eligibility and provide you with an updated I-20.  

Travel is NOT advised during the Cap Gap period. You should consult with your immigration attorney regarding any travel plans.

*Cap Exempt H-1B applications are not subject to the H-1B lottery and can begin at any time.  

** If you are no longer a student at UMass, your NENS access to UMass systems (access to UMass email, UMass VIP, etc.) will be deactivated 30 days after your  change of status begins. Please plan accordingly.
