According to the Office of the General Counsel, photo/video professionals must obtain signed consent forms to take photos, audio, or videos in private settings, such as classrooms and other areas not generally open to the public.
If the event is a gathering of many people, the photographer or videographer can post signs at entrances in lieu of consent forms. Consent forms are not required for images captured outdoors or in other public spaces. However, please ask permission whenever possible.
If photographing classes, meetings, talks, or conferences, include a notice in event registration or promotional materials. Post a visible sign at the entrance stating that the event will be photographed and that attendees grant UMass permission to use any resulting images.
The sign should include the following language:
“Please be aware: You are entering an area where photography, video, and audio recording may occur.”
- No release is required for public or outdoor spaces.
As mentioned above, photography/videography in outdoor areas or publicly accessible spaces does not require subject permission. - Student permission is generally covered.
Students grant UMass photo use rights as part of their registration agreement. However, if a student’s likeness is prominently featured, it’s best practice to obtain a signed release. - Consult Athletics for student–athlete images.
Due to NCAA Name, Image, and Likeness (NIL) regulations, always check with the Athletics Department before using photos of student–athletes. - Minors require a signed release.
A parent or guardian must sign a photo release form for any images that include minors. This is required regardless of setting or context.
